These general terms and conditions apply to all orders placed by private individuals via the online shop Teddyandmore.com from Romana Grzesiek, Kurmainzerstr. 101, 65936 Frankfurt am Main
(hereinafter “Teddy&More”).

§ 2 Conclusion of contract
§ 2.1 The product representations in the online shop serve to submit a purchase offer. By clicking the “Buy” button, you are making a binding purchase offer. Our products are only sold for private use in normal household quantities.
§ 2.2 We can accept your order by sending an order confirmation by email or by delivering the goods within five days. Confirmation of receipt of the order does not constitute acceptance of the purchase offer.
§ 2.3 If our order confirmation contains typographical or printing errors or if our price determination is based on technical transmission errors, we are entitled to challenge the order, although we must prove our error to you. Payments already made will be refunded to you immediately.
§ 3 Prices
The prices stated on the product pages include VAT and other price components and do not include postage.
§ 4 Shipping costs
§ 4.1 For delivery within Germany we charge a flat rate of EUR 4.50 per order.
§ 4.2 For delivery to Belgium, Bulgaria, Denmark, Finland, France, Greece, Ireland, Italy, Croatia, Luxembourg, Netherlands, Norway, Poland, Portugal, Romania, Sweden, Switzerland, Slovakia, Slovenia, Spain, Czech Republic, Hungary , United Kingdom and Austria we charge a flat rate of EUR 10.00 per order
§ 5 Delivery conditions
§ 5.1 Delivery takes place via Hermes (Germany) or DHL (abroad).
§ 5.2 If not all of the products ordered are in stock, we are entitled to make partial deliveries at our expense, provided this is reasonable for you.
§ 5.3 If delivery of the goods fails despite three attempts to deliver, we can withdraw from the contract. Any payments made will be refunded to you immediately.
§ 5.4 If the ordered product is not available because we are not supplied with this product by our suppliers through no fault of our own, we can withdraw from the contract. In this case, we will inform you immediately and, if necessary, suggest delivery of a comparable product. If no comparable product is available or you do not wish a comparable product to be delivered, we will immediately reimburse you for any consideration that has already been paid.
§ 6 Payment conditions
§ 6.1 Payment is made via PayPal Express Checkout or Shopify Payments
§ 6.2 If you default on payment, interest will be charged on the purchase price during the default at a rate of 5% above the base interest rate. We reserve the right to prove and claim higher damages caused by the delay.
§ 6.4 You only have the right to offset if your counterclaims have been legally established by a court, are undisputed or have been acknowledged by us in writing.
§ 6.5 You can only exercise a right of retention if the claims result from the same contractual relationship.
§ 7 Retention of title
The goods remain our property until full payment has been made. Before ownership is transferred, pledging, transfer as security, processing or redesigning without our consent is not permitted.
§ 8 Cancellation policy
§ 8.1 Consumers have a fourteen-day right of withdrawal.
§ 8.2 Please avoid damage and contamination. If possible, please send the goods back to us in the original packaging with all accessories and all packaging components. If necessary, use protective outer packaging. If you no longer have the original packaging, please ensure adequate protection against transport damage with suitable packaging in order to avoid claims for damages due to damage caused by inadequate packaging.
§ 8.3 Please send the goods back to us as an insured package and keep the delivery receipt.
§ 8.4 Before returning the item, please call us on +49 69 66009753 to announce the return. In this way, you enable us to assign the products as quickly as possible.
§ 8.5 Please note that the modalities mentioned in paragraphs 8.2 to 8.4 are not a prerequisite for the effective exercise of the right of withdrawal.
§ 9 Transport damage
§ 9.1 If goods are delivered with obvious transport damage, please complain about such errors to the delivery person and please contact us as quickly as possible on +49 69 66009753.
§ 9.2 Failure to make a complaint or contact us has no consequences for your statutory warranty rights. However, they help us to be able to assert our own claims against the carrier or the transport insurance company.
§ 10 Warranty
There are statutory warranty rights for all goods from our shop. The warranty is subject to legal regulations.
§ 11 Liability
We exclude our liability for slightly negligent breaches of duty, provided that these do not relate to essential contractual obligations, damages resulting from injury to life, body or health or guarantees or do not affect claims under the Product Liability Act. The same applies to breaches of duty by our vicarious agents.
§ 12 Final provisions
§ 12.1 If a provision of these General Terms and Conditions is invalid, the rest of the contract remains valid. The relevant statutory provisions apply in place of the invalid provision.
§ 12.2 German law applies.
